But thanks to the U.S. Supreme Court, the deputy did not have to take no for an answer. In the 2005 case Illinois v. Caballes, the Court declared that “the use of a well-trained narcotics-detection dog…during a lawful traffic stop generally does not implicate legitimate privacy interests.” So the deputy was free to walk his dog around Burns’ truck. “He got out with this dog and went around the car, two or three times,” Burns says. “He came back and said the dog had ‘passively alerted’ on my vehicle.”  via This Dog Can Send You to Jail – Reason.com.

    The reason for pull over is important. Even though we had no drugs our wife and I were searched and detained for 2 1/2hrs in Florida.We successfully sued the PD because they had no reason for suspicion; No pot smell, no slurring, no weaving nothing, it was simply to search.We had been pulled over for not having headlights on

    I highly doubt a police canine is out to “flake” anybody. Error? Maybe.
    A number of years ago I was someplace and a suspicious package was the reason for somebody to call 9-1-1. A police K-9 with the bomb unit arrived. I, pet the Lab as I owned a yellow Lab (English bloodline) who was more like a son to me. I was told not to touch the dog anymore. The dog was sent in, and a moment later it walked out in reverse, chin low to the ground, hair straight up on its back, and low growling. Time to back up a little more! The box was removed and we were told that it was detonated on the police range and, that it made a massive explosion of high pressure (no fireball). Until that dog came out “moon walking”, I thought the entire matter was a hoax. It was not. Dogs, I trust. Maybe it’s just my caveman brain.
    The Search & Seizure laws are always shifting. Why roadside searches are made at random, I cannot say, but until the Supreme Court says anything against them, I will not be surprised if I ever see TSA at these scenes, rubber gloves and all. It will only get worse because our government, on all levels, have declared gun owners as terrorists.
    I think of the old black and white movies of the Gestapo, “Vhere are your Papers?”
